SOCIAL SECURITY

Social Security. If you have been working and are disabled from working for at least twelve consecutive months, you should be entitled to Social Security benefits and payments. Social Security benefits are also available to persons who have worked only briefly or have never worked. For example, someone who has been disabled all of their life or who did not have 'out-of-home' employment may be eligible for benefits.

The process of obtaining Social Security benefits is somewhat complex. There are issues relating to your age, educational background and what sort of transferable skills you may have. Generally, you have a much greater likelihood of obtaining benefits if an attorney represents you.

There may also be issues to address even if you are awarded benefits. For instance, although you may receive a favorable decision, there may be aspects, such as your onset date, with which you may not agree. Your onset date is a very important aspect of your claim. It will affect the amount of your lump sum, retroactive benefits. It can impact on the date at which you become entitled to medical insurance benefits. We can help you if an onset date problem arises.

Our success rate in obtaining Social Security benefits for disabled persons is very high. Unlike other firms, our procedure is to immediately collect your medical records. These records are essential to prove your disability and the earliest onset date of your disability. If you have old medical records from years past, we also utilize them to show the origin of your disability. We do not wait until Social Security obtains the records. That will take time and they are likely not to be complete. Rather, we act as your advocate, from our process of getting each and every relevant medical record to arguing your case before the Administrative Law Judge and, if necessary, the Appeals Council and District Court.

Social Security matters are handled on a contingent fee basis, that is, you don't pay a fee unless we are successful. We are paid from your retroactive benefit. The maximum amount allowable is either 25% of your past benefits or $5,300, whichever is less. The fee is not tied to your future monthly benefits. There is no consultation fee and no attorney billing time. The fee structure will change only if we are representing you after a Hearing. However, in no case, will we ask you to pay fees, or costs, unless we are successful.
